eepro100 problems with 2.2.15pre[123]

this is exactly the same prob i have with 2.3.39 

transmit timed out, restarting transmitter ... 

Jan 18 21:54:56 dumbo kernel: eth0: Trying to restart the transmitter... 
Jan 19 08:48:38 dumbo kernel: eth0: Trying to restart the transmitter... 

has the code had same modifications recently for both 2.2. and 2.3 branch ? 
may be thats where the problem is ?
